Terms of Service

The rules for using Nutri — and your rights as a user. We’ve written these to be readable, not to trap you. If something isn’t clear, email us.Last updated: March 29, 2026

In plain English: Use Nutri responsibly, don’t try to break the service or another account, and don’t misuse other users’ data. We provide the service as-is during beta. You can cancel anytime. We never sell your health data. Your family’s information belongs to you.

1. Acceptance of terms

By creating an account, accessing, or using the Nutri application, website at nutri.ai, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service and our Privacy Policy.

If you are creating a household account that includes profiles for children under 13, you represent that you are the parent or legal guardian of those children and consent to these terms on their behalf.

If you do not agree to these terms, do not use the Service.

These terms constitute a binding legal agreement between you and Nutri, Inc. (“Nutri,” “we,” “us,” or “our”), a company incorporated in the United States.

2. Your account

Eligibility

You must be at least 18 years old to create a Nutri account. By creating an account, you confirm you meet this requirement. Child profiles (for household members under 18) must be created and managed by an adult account holder.

Account security

  • You are responsible for maintaining the confidentiality of your login credentials
  • You are responsible for all activity that occurs under your account
  • Notify us immediately at security@nutrismarts.ai if you suspect unauthorized access to your account
  • You may not share your account credentials or allow others outside your household to access your account

Account information

You agree to provide accurate, current, and complete information when creating your account and to keep this information up to date. Providing false information, including misrepresenting your identity or your relationship to household members, is grounds for account termination.

One account per household

Each household should maintain one primary account. Multiple accounts created to circumvent subscription limits or other restrictions are not permitted and may result in all associated accounts being suspended.

3. The service

Nutri provides AI-powered meal planning, nutrition tracking, grocery list generation, allergen management, and related family nutrition tools. The Service is provided through our mobile applications and website.

Beta service

During beta: the Service may experience downtime, feature changes, or behavior differently than described. We will provide reasonable advance notice of material changes. By joining the beta you acknowledge that the product is not yet feature-complete.

Service availability

We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. We reserve the right to:

  • Modify, suspend, or discontinue any feature or the entire Service with reasonable notice
  • Perform maintenance that temporarily affects availability, typically during low-usage hours
  • Limit access to certain features based on subscription tier

Not a medical service

See Section 9 (Medical Disclaimer) for important information about the non-medical nature of Nutri. Allergen alerts and nutrition tracking are provided as informational tools, not as medical advice or a substitute for professional guidance.

Billing

Premium subscriptions are billed monthly or annually, as selected at the time of purchase. Your subscription renews automatically unless cancelled before the renewal date. We will send a reminder email at least 7 days before your renewal date.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access to premium features until then. We do not provide prorated refunds for partial billing periods, except where required by applicable law.

Refunds

If you are dissatisfied with the Service within your first 14 days of a paid subscription, contact us at support@nutrismarts.ai for a full refund. After 14 days, refunds are issued only where required by law.

Price changes

We will provide at least 30 days’ notice before changing subscription prices. Price changes take effect at your next renewal. If you do not agree to a price change, you may cancel before it takes effect.

Taxes

Subscription prices are exclusive of applicable taxes. Taxes will be calculated and displayed at checkout based on your billing location.

5. Your content

Ownership

Your health data, meal logs, custom recipes, and any other content you create in Nutri are yours. We do not claim any ownership over your personal or family data.

License to us

By using Nutri, you grant us a limited, non-exclusive license to use your data solely to provide and improve the Service. This means:

  • We use your meal logs to generate personalized recommendations for you
  • We use anonymized, aggregated patterns across users to train and improve our AI models
  • We do not use your identifiable health data to train models that will serve other users

Data portability and deletion

You can export all your data or delete your account at any time from Account Settings. See our Privacy Policy for details on what we delete and when.

Content you should not enter

Please do not enter into Nutri data that belongs to someone else without their knowledge, or data that would constitute the medical records of a person not in your household. The Service is designed for personal family nutrition tracking, not clinical data management.

6. Child profiles & parental consent

Nutri supports household profiles for children under 18. For children under 13, we have additional requirements consistent with COPPA (Children’s Online Privacy Protection Act).

Parental responsibility

  • By creating a profile for a child under 13, you represent you are that child's parent or legal guardian
  • You take full responsibility for all use of the Service by household members under 18
  • You agree to supervise minor household members' use of the Service
  • You consent to the collection and use of the child's minimal profile information as described in our Privacy Policy

Child-specific restrictions

Child profiles (under 13) automatically have the following restrictions applied — these cannot be disabled:

  • No sponsored content, advertising, or promotional offers shown
  • No community or social features
  • No leaderboards or competitive features
  • No sweepstakes, contests, or prize opportunities
  • No sharing of profile data with third parties

Parental controls

As the primary account holder, you can at any time view, correct, or delete any child’s profile and all associated data from Account Settings → Family.

7. Prohibited uses

You agree not to use Nutri to:

  • Violate any applicable law, regulation, or third-party rights
  • Provide false or misleading health information that could endanger another person
  • Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems
  • Scrape, crawl, or extract data from the Service through automated means without prior written consent
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to build a competing product or service
  • Upload, transmit, or distribute malicious code, viruses, or harmful files
  • Harass, abuse, or harm any other user
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use the Service in any way that damages or overburdens our infrastructure
Violation of these prohibitions may result in immediate account termination without refund and, where appropriate, referral to law enforcement authorities.

8. Intellectual property

Our property

Nutri and its content — including the application, website, AI models, algorithms, recipes in our library, design elements, trademarks, and logos — are owned by Nutri, Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without prior written permission.

Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant us a royalty-free, worldwide license to use that feedback to improve our products. We will not compensate you for feedback, but we genuinely appreciate it.

Third-party content

The Service may include links to third-party websites, nutritional databases, or recipe sources. We do not control third-party content and are not responsible for its accuracy, completeness, or legality. Your use of third-party services is governed by those services’ own terms.

9. Medical disclaimer

Nutri is not a medical service. The content, features, and information provided by Nutri — including meal plans, nutrition tracking, allergen alerts, and AI recommendations — are for informational and convenience purposes only. They do not constitute medical advice, diagnosis, or treatment.

In particular:

  • Allergen alerts are informational only. Do not rely on Nutri as your sole means of managing life-threatening food allergies. Always verify ingredients directly and consult your physician or allergist for medical management of severe allergies.
  • Nutrition information may be imprecise. Nutritional data is sourced from third-party databases. Actual nutrient content may vary depending on preparation, sourcing, and other factors.
  • Consult a professional. Before making significant changes to your family’s diet, especially if any member has a health condition, please consult a registered dietitian, physician, or appropriate healthcare professional.
  • Not a substitute for emergency services. In a medical emergency, call emergency services (911) immediately. Do not rely on Nutri for emergency dietary guidance.

Nutri is built with healthcare-grade security principles to protect your family’s data — but this refers to our data security practices, not to any clinical or regulatory medical status.

10. Limitation of liability

Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF NUTRITIONAL DATA, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NUTRI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, HEALTH OUTCOMES, OR ECONOMIC LOSS.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Exceptions

Some jurisdictions do not allow limitation of liability for personal injury or certain other types of damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these terms limits our liability for fraud, gross negligence, or willful misconduct.

11. Termination

Your right to cancel

You may delete your account at any time from Account Settings → Delete Account. Deletion is permanent and irreversible after 30 days. During the 30-day period, you may contact us to restore your account if you change your mind.

Our right to terminate

We may suspend or terminate your account immediately if you:

  • Violate these Terms of Service
  • Engage in fraudulent or illegal activity using the Service
  • Fail to pay subscription fees (with reasonable notice and cure period)
  • Provide false information that cannot be corrected

Where possible, we will give you notice and an opportunity to correct the issue before terminating your account. For serious violations, we may terminate without notice.

Effect of termination

Upon account deletion or termination, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute resolution) will survive.

12. Disputes & governing law

Informal resolution first

If you have a dispute with Nutri, please contact us first at support@nutrismarts.ai. Most issues can be resolved quickly and informally. We will try to respond within 5 business days.

Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Delaware for any disputes not resolved informally.

Class action waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE TO BRING ANY DISPUTE AGAINST NUTRI IN YOUR INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION PROCEEDING.

Consumer rights

Nothing in these terms affects your statutory rights as a consumer that cannot be waived under applicable law. If you are a consumer in the European Union, United Kingdom, or California, additional rights may apply to you that supersede these terms.

13. Changes to these terms

We may revise these terms from time to time. For material changes — those that significantly affect your rights or obligations — we will:

  • Send an email notification at least 30 days before the changes take effect
  • Display a prominent notice in the app
  • Require your affirmative acceptance before the new terms apply to you

For minor, non-material changes (such as correcting typos or clarifying existing practices), we will update the “Last updated” date at the top of this page.

If you do not agree to revised terms, you may delete your account before the changes take effect. Continued use of the Service after the effective date of new terms constitutes acceptance of those terms.
